The Food Safety and Standards Authority of India (FSSAI) has opened three separate adjudication cases against Nestlé India concerning promotional claims made for certain infant nutrition products and a laboratory finding related to biotin content in a follow-up formula.
Cases Related to Promotional Claims
FSSAI examined promotional material available on e-commerce platforms for two products:
NAN Excella Pro Stage 1: Claims relating to “5 HMOs” (human milk oligosaccharides) and “Whey Protein” were flagged.
Lactogen Pro 1: A claim describing “Whey Protein” as “easy to digest” was noted.
The regulator stated that these claims contravene Regulation 4(2) of the Food Safety and Standards (Foods for Infant Nutrition) Regulations, 2020. This provision restricts promotional claims or material intended to increase the saleability of infant foods. Clarifications were sought from Nestlé India before the cases were filed.
BiotinTest Failure
In a separate case, a sample of a Nestlé India follow-up formula was found to be sub-standard with respect to biotin during laboratory analysis.The same sample was sent to a referral laboratory, which also confirmed that it did not conform to the prescribed biotin requirement under the 2020 regulations. The standards specify a biotin content of 7.5 to 50 micrograms per 100 grams of the product. Biotin (vitamin B7) is a water-soluble vitamin important for metabolic processes.
Official Action
FSSAI has filed three separate adjudication cases against Nestlé India Limited in respect of the three products. The proceedings will determine the regulatory consequences.No product recall has been announced at this stage, and the regulator has not indicated that the findings relate to all batches of the products.Parents and consumers are advised to follow official updates from FSSAI regarding any further action or advisories related to infant nutrition products.
